Official Rules
NO PURCHASE NECESSARY TO PARTICIPATE IN PROGRAM. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING. VOID WHERE PROHIBITED. INTERNET ACCESS AND VALID E-MAIL ACCOUNT NECESSARY TO PARTICIPATE.
1. ELIGIBILITY
ASIAN SENSATIONS® Products and RED BARON® Singles (the "Brands") "You Could Win a Private Concert Starring Julie Roberts Promotion" (the "Promotion") is offered only to individuals who are legal residents of the 50 United States or District of Columbia and at least 18 years old, or the age of majority in the jurisdiction in which participant resides, at time of participation. Employees, officers and directors of Schwan's Consumer Brands North America, Inc. ("Sponsor"), Ain't Skeer'd Tours, Inc., Wilhelmina Artist Management LLC, their respective parents, affiliated and subsidiary companies, advertising and promotional agencies, web masters and web suppliers and persons engaged in the development of Promotion materials, and members of the immediate family (parents, siblings, children and spouse, wherever they reside) or household members (whether or not related) of such employees, officers and directors are not eligible. Groups, clubs, organizations, commercial entities, and businesses cannot participate. By participating, you agree to these Official Rules and all decisions of the Sponsor, which are final and binding in all respects.
2. PROMOTIONAL PERIOD
Promotion begins on or about March 1, 2008 at 12:01:01 a.m. Eastern Time (ET) and ends on July 31, 2008 at 11:59:59 p.m. ET. A day begins at 12:01:01 a.m. ET and ends at 11:59:59 p.m. ET on the same day. The Promotion computer is the official clock for the Promotion.
3. HOW TO PARTICIPATE
To participate, you must first obtain a Code, then register at the Promotion Micro-Site at www.myconcertwithjulie.com, as follows:
Obtain a Code
There are two ways to obtain a Code: (a) Purchase the Brands' specially-marked participating packages of the following Frozen Snack/Handheld Products, while supplies last: RED BARON® Deep Dish Singles, RED BARON® Classic Crust Microwavable, RED BARON® Thin and Crispy Singles, RED BARON® French Bread Pizza, and ASIAN SENSATIONS® Egg Rolls and ASIAN SENSATIONS® Appetizers. Look for the 7-digit alpha-numeric Code printed on the insert in the specially-marked package; or (b) To play without purchase, you may request a Code online at www.myconcertwithjulie.com. Follow the instructions online to play and you will receive a Code via e-mail.
Register at the Micro-Site
Access www.myconcertwithjulie.com ("Micro-Site") and click on the icon, banner, or text link to access the registration page. Then:
1. Complete the registration form with your complete name, e-mail address, mailing address, primary phone number, date of birth, and zip Code and confirm that you have read and agree to these Official Rules.
2. Enter your Code exactly as it appears on your specially-marked package material or free Code obtained online. If it is not entered exactly as it appears, it will not be accepted.
3. You will be asked to complete a brief survey. Your answers will have no effect on your ability to participate or win.
4. Follow the directions to submit the registration information and the Code to enter the Promotion.
5. KEEP YOUR ORIGINAL SPECIALLY-MARKED PACKAGE MATERIAL WITH CODE AND/OR YOUR FREE CODE E-MAIL MATERIAL FOR VERIFICATION PURPOSES.
Once you are registered, a Promotion Account ("Account") will be created for you. When you return to the Micro-Site you will be asked to log-in by providing your name and e-mail address. This accesses your Account. You can then enter additional Code(s) to participate in the Promotion more than once. Click on the submit button to record your entry/play. Limit one entry/play per person, per e-mail address, per day.
All Codes must be entered, received and recorded by the Promotion computer by July 31, 2008 at 11:59:59 p.m. ET and if all Codes are not entered, received and recorded by then, they cannot be entered, are void, and are forfeited. Codes submitted in any manner other than as stated in these Official Rules are void and will not be honored or returned. The sale, trading, transfer, assignment, combining, or barter of any Code's specially-marked package materials, Code e-mail materials (collectively "Code Materials") or Codes is prohibited. Code Materials, and Codes have no cash value, and may not be purchased or redeemed for cash or credit. Codes may only be used in a manner consistent with, and as stated in, these Official Rules.
Each time you visit the Micro-Site to participate in the Promotion, you must log-in using your name and e-mail address. Any attempt to enter more than the stated number of entries/plays permitted by the Official Rules using multiple/different e-mail addresses, identities, registrations and/or logins or any other methods will void all such entries and may result in disqualification. Use of any automated, programmed system to participate is prohibited and will result in disqualification.
4. TO PARTICIPATE IN THE INSTANT-WIN GAME
Instant-Win Game – How to Play, Prizes, and Odds
For each of the 210 Instant-Win prizes, one randomly selected date and time will be pre-selected, and the eligible participant entering the first valid Code which is received and recorded by the Promotion computer at such time (or closest thereafter) will be deemed the winner of that Instant-Win Prize (subject to verification and compliance with these Official Rules). Limit one Instant-Win play per person, per e-mail address, per day. Limit one Instant-Win prize per person. If you have won a prize, you will be instructed on the method for claiming the prize.
Instant-Win Prizes
Thirty (30) iPod® nanos. Approximate Retail Value ("ARV") $200.00 each; (80) iTunes® Gift Cards. Terms and conditions of Gift Card apply. ARV $50.00 each; (100) Julie Roberts' Merchandise. ARV $15.00 each or greater. Total ARV of all Instant-Win prizes $11,500.00.
Odds of winning Instant-Win prize are dependent on the number of participants and valid Codes entered, the random times selected for prizes and the time any particular participant plays. The order in which the Instant-Win prizes are awarded shall be at Sponsor's sole discretion. INSTANT-WIN PRIZES WHICH ARE NOT CLAIMED OR ARE FORFEITED WILL NOT BE AWARDED.
5. TO PARTICIPATE IN RANDOM DRAWING
How to Play, Prize, and Odds
Each time a valid Code is entered and received you will automatically receive one (1) entry into the random drawing. Limit one entry per person, per e-mail address, per day. The Grand Prize winner will be selected in a random drawing on or about August 3, 2008 from among all eligible entries received. Winner will be notified by mail, overnight mail or such other method as determined by the Sponsor on or about August 5, 2008.
Grand Prize
A private concert performed by Julie Roberts. The concert is to take place at a venue and at a time and on a date during 2008 selected solely by the Sponsor; (and subject to Ms. Roberts' availability) and in or within 150 miles of the winner's hometown. The winner may invite no more than 100 guests to the concert and must provide an exact number of guests to the Sponsor within 10 days of receiving the award letter. Grand Prize also includes limo transportation to and from the event, and one-night hotel stay (double occupancy) for winner and one guest. Winner receives a $500.00 shopping spree delivered via a pre-paid debit card; and $100.00 spending money. ARV of Grand Prize: $20,000.00. THE WINNER AND HIS/HER GUESTS WILL BE SOLELY RESPONSIBLE FOR ANY OTHER EXPENSES NOT SPECIFICALLY STATED IN THESE OFFICIAL RULES THAT ARE INCURRED TO ATTEND THE CONCERT. Neither the Sponsor nor any other Releasees (as defined below) will have any liability or responsibility for any such transportation or any such expenses, or any other expenses incurred to attend the concert. The Sponsor will provide a selection of food and non-alcoholic beverage (as solely determined by Sponsor) in addition to wait-staff and bear responsibility for securing permits or permission if required. Guests must be no younger than the age of majority in the jurisdiction in which the concert takes place unless the minor is accompanied by his/her parent/legal guardian. Sponsor reserves the right to terminate the concert and/or remove any person from the concert should any person in attendance act in a manner which could in the sole opinion of Sponsor endanger person(s) or property, and/or is disruptive, or otherwise acts in a manner which Sponsor, in its sole opinion, deems inappropriate. The actual prize value may differ from the above stated value due to, for example but not limited to, venue and guests, and any difference between the actual value and stated value will not be awarded. Winners will be notified of the location of the event venue within approximately two (2) weeks of award notification. The Grand Prize will be awarded provided a sufficient number of eligible entries is received. Odds of winning the Grand Prize depend on the number of eligible entries received.
6. CONDITIONS FOR ALL PRIZES
No prize can be substituted, assigned, transferred, or redeemed for cash, but Sponsor reserves the right to substitute any prize of equal or greater value should a prize become unavailable. Expenses not stated are the sole responsibility of the prize winner. If a prize winner cannot accept a prize as stated, the Instant-Win prize will be forfeited in its entirety but if it is the Grand Prize it will be awarded to an alternate winner via a random drawing. Any difference between the stated and actual value of a prize will not be awarded. All details and other restrictions of prizes not specified in these Official Rules will be determined solely by Sponsor. All federal, state and local taxes, if any, are the sole responsibility of winners. Total ARV of all prizes is $31,500.00.
7. GENERAL CONDITIONS
Participants agree (a) that Sponsor, Ain't Skeer'd Tours, Inc., Wilhelmina Artist Management LLC, Julie Roberts, and their respective parents, affiliated and subsidiary companies, advertising and promotional agencies, web masters and web suppliers and persons engaged in the development of Promotion materials (individually and collectively "Releasees") will have no liability whatsoever for, and shall be indemnified and held harmless by participants against any liability for any injuries, losses or damages (whether due to negligence or otherwise) of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, or participation in this Promotion or Promotion-related or travel related activities and (b) winners grant, (and agree to confirm such grant in writing promptly upon request) to the Sponsor and those acting under the Sponsor's authority the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information in perpetuity for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the World Wide Web, without review, notification or approval, and additional compensation, unless prohibited by law. In no event will Releasees be responsible or liable for any damages or losses of any kind, whether direct, indirect, incidental, consequential, punitive or other damages. Winners may be required to complete, sign, and return an Affidavit of Eligibility, a Liability Release and, where lawful a Publicity Release within seven (7) business days of date on notification. If documents are not returned on a timely basis, if any notification or prize is returned as non-deliverable, or if a winner is found to be ineligible or not in compliance with these Official Rules, such Instant-Win prize may be forfeited, but if it is the Grand Prize it will be awarded to an alternate winner via a random drawing. Concert winner's guests may be required to execute a Liability Release, and where lawful a Publicity Release, prior to attending the concert, and if a guest is a minor the Releases must be executed by the minor's parent/legal guardian on behalf of himself/herself and the minor, and the parent/legal guardian must accompany the minor, throughout the private concert.
8. VERIFICATION
The Sponsor reserves the right to request that any participant forward to the Sponsor proof of eligibility in a form determined by Sponsor and/or the Code Materials with the original Codes. Failure to comply with this request within the time stated in the request may cause disqualification. Validation Procedure: All Code Materials may be reviewed for authenticity. If the proof of eligibility and/or Code Materials are not received within the time specified on the request said participant may be disqualified. All submitted materials become property of the Sponsor, and will not be returned. If further investigation is required to ensure that the participant is eligible and/or the Code Materials and Codes submitted are legitimate, the Sponsor will retain the participants Code Materials, Codes and Account. The use of the Codes in a participant's Account may be suspended during the pendency of the investigation. By participating, participant agrees to cooperate fully in any investigation. If it is determined that there are any irregularities in any materials submitted and/or the participant is not eligible, disqualification and Code forfeiture may result. Code Materials and Codes themselves will be void if they contain printing or other mechanical errors, are printed or produced in error, fail to contain special anti-fraud security markings that may be applied at the time of production, are not obtained through authorized, legitimate channels, if any part is defective, illegible, altered, duplicated, photocopied, reproduced, forged, counterfeited, defaced, mutilated or tampered with in any way, or if they contain, or are the result of, a printing, seeding, typographical, mechanical, digital, electronic or other errors. Sole liability for any Code Materials or Codes containing printing or other irregularities and/or errors, or which reveal an illegible or unreadable Code or for any irregular Instant-Win play, is limited to replacement with a free randomly selected Code or Instant-Win play (as solely determined by the Sponsor) while supplies last. No more than the stated number of prizes will be awarded. In the event that production, seeding, electronic, digital or programming failures, or other reasons or errors cause more than the stated number of prizes, set forth in these Official Rules in any prize category, to be available and/or claimed, the Sponsor reserves the right to award only the number of prizes stated in that category in these Official Rules (previously not awarded), by a random drawing among all legitimate eligible prize claimants for prizes in that category.
9. LIMITATIONS OF LIABILITY
Releasees are not responsible for lost, late, incomplete, garbled, illegible, fraudulent, or misdirected, entries or e-mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/website/use net accessibility, availability, or traffic congestion, or any technical error, or unauthorized intervention, or the incorrect or inaccurate capture of registration, Code, entry or other information, or the failure to capture, or loss of, any such information. Releasees are not responsible for any incorrect or inaccurate information, whether caused by Micro-Site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Promotion and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Micro-Site. The right is reserved by the Sponsor at their sole discretion, to disqualify any individual found, at their sole discretion, to be tampering with the entry process or the operation of the Promotion or Micro-Site, to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed, third party or like Code entry or entry methods will void all such Code entry(s) and entry(s) by such methods, and disqualify any participant using such methods. Releasees are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion or downloading materials from a Micro-Site or use of a Micro-Site. If, for any reason, the Promotion is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which the Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion or proceed with the Promotion in a manner deemed fair and appropriate by the Sponsor. In case of dispute, Codes entered and/or used will be declared entered and/or used by the authorized Account holder under whose e-mail address and password the Code was entered and/or used.
